Tubudd.,JSC, a joint stock travel company incorporated under vietnamese law, vat number 0108305670, having its registered address at 5th floor, no.7, alley 3, lieu giai street, ngoc ha ward, hanoi city, vietnam, provides additional travel-related services for travelers to vietnam, including but not limited to visa facilitation, private transportation, accommodation booking, and airport fast track services. These terms and conditions (as amended from time to time, the “terms”) govern the use of these additional services (the “services”) provided by Tubudd.,JSC and access of such services through the website www.tubudd.com (the “site”) or application for mobile devices (the “application”). By using the site, application, or booking any of these services, you agree to be bound by these terms. If you do not agree with these terms or any part of them, you must not use the site, application, or services.

1. KEY DEFINITIONS AND INTERPRETATION

“Content” means text, graphics, images, music, software, audio, video, information or other materials. “Tubudd” means services that a buddy may provide to a traveller in relation to a specific travel destination (e.g. Picking up from the airport, showing the best bars and restaurants in town, sightseeing or visiting non-touristic places, etc.). The services must comply with local and international legal regulations. Firms or legal entities cannot register and provide tubudd services as locals on the tubudd platform. “User” means an individual who completes tubudd.com account registration process, including but not limited to the buddies and travellers. “Buddy” means a user - a natural person who creates the profile via the site and application and provides the tubudd services. “User content” means all content that a user posts, uploads, publishes, submits or transmits to be made available through the site, application or services. “Traveller” means a user who requests from a local a booking of the tubudd via the site, application or services. “you”, “your” and “yours” means you a user of the site or application. “we”, “us” and “our” are references to Tubudd.,JSC.

1.1. Interpretation of a Tubudd host

On Tubudd, a "host" is a broad definition of a person who resides in a certain location and wishes to share his personal local experience with travelers he meets on tubudd so that they can become acquainted with the area from the perspective of a local. Tubudd local hosts must meet all legal requirements to give tours in their area. In some cases, and in some locations, this means that a specific license has to be obtained from an appropriate authority. However, if a tubudd host is simply accompanying travelers, offers practical advice or shares his experience about "best bars and restaurants", "non-touristy spots", "shopping areas" etc. He may just be a passionate local person without any formal training in tour organizing.

2. SERVICES

2.1. Visa Services (E-Visa and Visa on Arrival)

2.1.1. Description of the services

Tubudd.,JSC acts as a facilitator in processing visa applications to vietnam, including e-visa and visa on arrival services. We assist in the preparation and submission of documents to the relevant authorities.

2.1.2. Important Disclaimers

Visa issuance is at the sole discretion of the vietnamese immigration department. Tubudd.,JSC does not guarantee approval, processing time, or issuance of visas.
All applications, once submitted, are strictly non-refundable, even if refused by immigration.
If Tubudd.,JSC fails to process an application due to our own error or cannot deliver an expedited visa within the promised timeframe, the service fee and any minor government fee will be refunded in full.

2.1.3. Customer obligations

You are solely responsible for providing accurate and complete information (including passport details, travel dates, and flight information).
Tubudd.,JSC is not liable for rejection, delays, or loss of service due to incorrect or incomplete information provided by you.
It is highly adviced for you to have visa before booking flights and other arrangements to travel. Tubudd.,JSC is not liable for all the services loss due to failed visa.

2.2. Private Transportation

2.2.1. Description of the services

Tubudd.,JSC provides private transfers and transportation within vietnam, arranged through third-party providers, including freelance drivers, licensed car rental companies, and taxi operators.

2.2.2. Important Disclaimers

Tubudd.,JSC does not own or operate vehicles directly and acts as an intermediary between you and third-party providers.
While we make every effort to select reliable providers, Tubudd.,JSC does not accept liability for accidents, delays, cancellations, vehicle conditions, or unforeseen events caused by third parties.

2.2.3. Cancellations and Refunds

All transportation services must be prepaid in full.
Cancellations and refunds (if applicable) follow the cancellation terms provided at the time of booking. No-shows are strictly non-refundable.

2.3. Accommodation Booking

2.3.1. Description of the services

Tubudd.,JSC facilitates hotel and accommodation bookings on behalf of travelers.

2.3.2. Important Disclaimers

Tubudd.,JSC acts only as an intermediary and is not the owner, operator, or manager of accommodation facilities.
Accommodation quality, safety, services, facilities, and amenities are the sole responsibility of the hotel or property provider.

2.3.3. Cancellations and Refunds

All accommodation bookings are subject to the hotel’s policies regarding cancellations, refunds, and amendments.
Tubudd.,JSC shall not be liable for disputes related to accommodation services; any disputes must be resolved directly with the accommodation provider.

2.4. Airport Fast Track Services (Vietnam only)

2.4.1. Description of the services

Tubudd.,JSC arranges airport fast track services for arrivals and departures in vietnam to facilitate smoother immigration and airport procedures.

2.4.2. Term of Use

Bookings must be made in advance and prepaid in full.
Last-minute bookings (within 4 hours before arrival or 6 hours before departure) are subject to a surcharge of usd 15 per person per time.
Nighttime bookings (arrivals 23:00–06:00; departures 23:00–08:00) are subject to a surcharge of usd 5 per person per time.

2.4.3. Refunds and Liability

No refund will be issued in cases of customer no-shows.
No refund will be issued if the customer arrives and decides not to use the service.
If the service is not provided as confirmed and proof is submitted, a 100% refund will be issued.
If the customer arrives more than 30 minutes late for a departure fast track booking, Tubudd.,JSC shall not be responsible for missed flights and no refund will be issued.
If the customer arrives earlier than the confirmed time, advance notice is required to arrange staff.
If a flight is delayed, Tubudd.,JSC will track and adjust for the new arrival time.
If the customer changes flights without notifying Tubudd.,JSC, resulting in failure of service delivery, no refund will be issued.

3. INTELLECTUAL PROPERTY

All intellectual property to the content (except for the user content) featured or displayed on the site or application or via the services is the property of Tubudd.,JSC and is protected by copyright laws, patent and trademark laws and other legislation. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the site, application or services. Subject to your compliance with these terms, Tubudd.,JSC grants you a limited, non-exclusive, non-sub licensable, revocable, non-transferable license to (i) access and use the site and application solely in connection with your use of the services, and (ii) access and use any content, information and related materials that may be made available through the services.

4. NETWORK ACCESS

You are responsible for obtaining the data network access necessary to use the services. You understand that such access may involve third-party fees (such as internet service providers).

5. NETWORK ACCESS

You are solely responsible for all user content that you upload, post, publish or display or email or otherwise use via the services. All user content submitted by you on the site or application or via the services will be considered non-confidential and non-exclusive. You grant to Tubudd.,JSC a non-exclusive, irrevocable, worldwide, transferable, royalty-free, perpetual right to use your user content in any manner or media now or later developed, with the right to sublicense, to use, copy, modify, create derivative works of, distribute, publicly display, publicly perform, and otherwise exploit in any manner in all formats and distribution channels. We reserve the right to monitor all user content uploaded to the site or application at any time. We may decide, without notice to you, to remove, edit or delete any user content where we consider at our sole discretion that such user content is either bogus or in breach of these terms. If Tubudd.,JSC chooses to monitor any user content, it assumes no responsibility for, or any obligation to monitor or remove, such user content.

6. PAYMENT

All services are prepaid in full at the time of booking.
Payments may be accepted in usd, vnd, or other currencies as indicated on the site or application.
Services are not confirmed until full payment has been received by Tubudd.,JSC.
We offer 4 ways of payment methods: paypal, direct payment link (payme), bank transfer and western union
Any cancellation must be initiated by telephone to the tubudd office at +(84) 896 684 588 or by email to [email protected]. We will acknowledge and confirm your cancellation by email. If, as a traveller, you do not cancel your booking prior to the day of the trip, the payment is not refundable. Any refunds will be made by us within a commercially reasonable time of the cancellation or request for a refund.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Tubudd.,JSC’s liability for any claim relating to the services shall be limited to the amount paid for the specific service giving rise to the claim.
Tubudd.,JSC shall not be liable for any indirect, consequential, or incidental damages, including but not limited to delays, loss of flights, loss of accommodation, loss of income, or reputational damages.
Force majeure events (including but not limited to strikes, weather conditions, natural disasters, government restrictions, or technical issues beyond Tubudd.,JSC’s control) shall release Tubudd.,JSC from any liability or obligation to provide compensation.

8. INDEMNITY

You agree to indemnify, defend, and hold harmless Tubudd.,JSC, its directors, employees, and partners from any claims, liabilities, damages, costs, or expenses (including legal fees) arising from:

Your breach of these terms;
Any inaccurate or false information provided by you;
Any misuse of the services.

9. MISCELLANEOUS

These terms form part of and are to be read together with Tubudd.,JSC’s general terms & conditions.
Tubudd.,JSC may use subcontractors and third-party providers to perform these services. Such parties shall comply with these terms.
Tubudd.,JSC reserves the right to modify or discontinue these services at any time without prior notice.
The use of these services shall not create any partnership, employment, or joint venture relationship between you and Tubudd.,JSC.
These terms are governed exclusively by vietnamese law. Any disputes shall be subject to the jurisdiction of the competent courts in vietnam.
